CMM Court Dhaka : A case has been filed in the lower court on the pretext of the written order of the High Court. The incident came to light during a writ hearing of a bench of the High Court comprising Justice M Enayetur Rahim and Justice Mostafizur Rahman yesterday.

It is learned that a bench comprising Justice Enayetur Rahim and Justice Mostafizur Rahman heard two writ petitions against Rajarbagh Darbar Sharif on December 5.

Advocate Shishir Monir, counsel for a writ petitioner, told a press briefing at the end of the hearing, “The court has ordered that in the light of the CID’s investigation report, the victims can file a case against the accused in Rajarbagh Dabbar Sharif if they wish.”

The news was spread in different media. Taking advantage of that opportunity, writ petitioner Abdul Quader filed a case against several members of Rajarabagh Durbar Sharif in the Dhaka CMM Court on December 8, citing the High Court order.

A hearing was held on December 14 in the context of the writ petition filed by the persons in favor of the writ petition seeking redressal of the harassment case.

At the hearing, a bench comprising Justice Enayetur Rahim and Justice Mostafizur Rahman said, “I have not signed any order yet. Why are you all so hyper? First see what I order, then talk about it. ”

Regarding the writ petition filed by the petitioner against Rajarbagh Darbar Sharif, the court said, “They should not have filed such a case before receiving the written order. ”

Finally, the court said, “You are all very hyper, have a little patience, first see what I order. The court further said, “I have accepted the request of all of you. I will hear more details in this regard on 13/02/2022.”

Advocate Muhammad Zahurul Islam Mukul, Advocate Muhammad Ahsan, Advocate Julhas Uddin Ahmad, Barrister Golam Mostafa Taj, Advocate Shahid Kamruzzaman and Advocate were present in the court on behalf of the petitioners.

On the other hand, Advocate Emdadul Haque Bashir appeared as counsel for the petitioner. Bipul Bagmar was on the side of the state.
